Powers of Attorney & Attestations in Malta
Formal proof, properly given. Much of what a notary does day to day is neither lengthy nor complicated, but it must be done correctly if it is to be relied upon — and the occasions on which it is relied upon are seldom convenient ones.
Powers of Attorney
A power of attorney authorises another to act in your name. A general power confers a broad authority to administer your affairs; a special power is confined to a defined act — appearing on a deed of sale, operating an account, representing you before an authority. The narrower instrument is usually the better one, and we advise on the scope that the purpose actually requires rather than drafting more widely than is needed.
Powers are frequently wanted by those who live abroad and cannot attend in person, or who will be away when a deed falls due. We draft them, attend to their form, and advise on what will be needed for the mandate to be accepted where it is to be used.
Affidavits and Oaths
As Commissioners for Oaths we receive affidavits and administer the oaths required for proceedings, applications and declarations of every ordinary kind. The deponent attends, the contents are read and confirmed, and the document is signed and sealed before us.
Certified True Copies
Originals are often required where an original cannot be surrendered. We compare the copy against the document produced and certify it as a true copy — for passports and identity documents, academic qualifications, company records, and the documentation required in the ordinary course of applications to banks and public authorities.
Attendance and Appointments
These matters are dealt with at our office in Mosta by appointment, and usually without delay. Where a signatory is unable to attend by reason of illness or infirmity, an attendance elsewhere can generally be arranged. If you are unsure what form your document needs to take, tell us what it is for and we will say what is required.
